Historically, rape was defined as unlawful sexual intercourse with a woman against her will. The necessary elements of the crime were sexual penetration, force, and lack of consent. Women who were victims of rape were expected to have physically resisted to the utmost of their powers or their assailant would not be convicted of rape. Additionally, a husband could have sex with his wife against her will without being charged with rape. Nowadays, lawmakers and courts expanded and redefined the crime of rape to reflect modern notions of equality and legal propriety.
Lack of consent is a necessary element of the crime of rape. But this does not mean that a person may make sexual contact with a minor or incapacitated person who actually consented. Lack of consent may result from either forcible compulsion by the perpetrator or an incapacity on the part of the victim to give consent. Persons who are physically or mentally helpless or who are under a certain age in relation to the perpetrator are deemed legally incapable of consenting to sex.
Though the overwhelming majority of rape victims are women, a woman may be convicted of raping a man, a man may be convicted of raping a man, and a woman may be convicted of raping another woman. Furthermore, a spouse may be convicted of rape if the perpetrator forces the other spouse to have non-consensual sex.
The following are the 13 types of rape:
Acquaintance Rape-Acquaintance rape is perpetrated by a person who is known to the victim. Examples of acquaintances include someone the victim is dating, a classmate, co-worker, employer, family member, spouse, counselor, therapist, religious official or medical doctor
Date Rape-forcible sexual intercourse by a male of a woman, during a voluntary social engagement in which the woman did not intend to submit to the sexual advances and resisted the acts by verbal refusals, denials or pleas to stop, and/or physical resistance.
Gray Rape-An unclear case of alleged rape, for instance when the victim cannot demonstrate non-consent.
Marital Rape-is any unwanted sexual acts by a spouse or ex-spouse, committed without consent and/or against a person’s will, obtained by force, or threat of force, intimidation, or when a person is unable to consent
Statutory Rape-refers to sexual relations involving someone below the “age of consent.” People below the age of consent cannot legally consent to having sex. This means that sex with them, by definition, violates the law
Prison Rape- or jail rape is rape occurring in prison. It refers to rape of inmates by other inmates, and less commonly to the rape of inmates by staff, and even less commonly rape of staff by inmates.
Gang Rape-occurs when a group of people participate in the rape of a single victim it often involve three or more men as perpetrators. The gang members typically dehumanize their target victim before and during the rape.This rape has characteristics beyond those found in rape by individuals; for example, gang rapists tend to be younger and serial in their crimes, the gang is more often under the influence of drugs or alcohol, of the same race or religion or place of residence, thereby, forming a close-knit peer pressure group.
Serial Rape-committed by a serial rapist who forces a series of victims into unwanted sexual activity. Similar to a serial killer, the rapist will have a cooling off period in-between crimes.
Campus Rape- sexual assault of a student attending an institution of higher learning, such as a college or university.
Corrective Rape-is a hate crime in which one or more people are raped because of their perceived sexual orientation or gender. The common intended consequence of the rape, as seen by the perpetrator, is to turn the person heterosexual or to enforce conformity with gender stereotypes. The term corrective rape was coined in South Africa after well-known cases of corrective rapes of lesbians.
Genocidal Rape- is a term used to describe the actions of a group who have carried out acts of mass rape during wartime against their perceived enemy as part of a genocidal campaign.While war rape has been a recurrent feature in conflicts throughout history, it has usually been looked upon as a by-product of conflict, and not an integral part of military policy.
Unacknowledged Rape-sexual experience that meets the legal requirements of rape but is not labeled as rape by the victim. It is possible that unacknowledged rape victims use counterfactual thinking to cognitively reorganize the experience into something other than rape. Counterfactual thinking occurs when an individual mentally morphs, restructures, or changes events.
Rape by Deception- is a crime in which the perpetrator has the victim’s sexual consent and compliance, but gains it through deception or fraudulent statements or actions.
